How to Register a Society in India
Society registration is carried out at the state level with the respective Registrar of Societies under the Societies Registration Act, 1860. The process centres on preparing the governing documents and filing them with the appropriate supporting papers.
1Step 1: Reserve a Unique Society Name
Choose a distinctive name that is not identical to any existing society and does not violate the Emblems and Names (Prevention of Improper Use) Act, 1950.
2Step 2: Draft the Memorandum of Association
Prepare the MOA stating the society name, registered office address, objectives, and the details of the founding members and governing body.
3Step 3: Frame the Rules & Regulations
Draft the bye-laws governing membership, meetings, elections, the powers of office-bearers, amendments, and dissolution procedures.
4Step 4: File the Application with the Registrar
Submit the MOA, Rules & Regulations, member list, and supporting documents to the state Registrar of Societies with the prescribed fee.
5Step 5: Document Verification
The Registrar scrutinizes all documents and may raise queries or seek clarifications before proceeding to registration.
6Step 6: Registration Certificate
On approval, the Registrar issues the Certificate of Registration, after which the society can operate legally in its own name.
